Texas offers some of the strongest debtor protection laws in the country. In fact, it’s the only state that provides an unlimited homestead exemption, as most of you may know. In Texas, most property acquired during marriage is considered community property, no matter whose name is on the title. Debts, however, are treated differently. A debt incurred in one spouse’s name alone generally remains that spouse’s responsibility. For instance, if the husband takes out a credit card or a business loan in his own name, the wife is typically not liable for those debts.
